Legally Defensible Assessment Report Writing

 

Special education assessments are one of the most important components and building blocks of the individualized education program (IEP) process. Assessments meet a local educational agency’s (LEA’s) child find obligations. They provide the data necessary to determine eligibility as well as exit for special education. They teach teams about students and tell the story of each child’s “unique circumstances.” Assessment reports provide parents with an opportunity for participation in the IEP process and help parents to understand their children. Unfortunately, assessment reports are often the reason that LEAs lose in due process hearings because assessment reports do not provide us with these tools and are determined not to meet the legal standards required by the Individuals with Disabilities Education Act (IDEA) and related California law. This workshop will explore the requirements of a legally defensible assessment report through reviewing the applicable code sections, relevant case law, and actual assessment report examples. We will discuss how to incorporate real life data to prevent over reliance on standardized assessment results; better assessment reports do not necessarily require additional testing time. Attendees will have the opportunity to actively participate and ask questions throughout the workshop.
